OVERVIEW OF THE DEPARTMENT

Since1992, the Wills, Trusts, Estates & Taxation Department of MacDonald Rudy Byrns O’Neill & Yamauchi, a Limited Law Liability Partnership, LLP, has provided legal representation involving routine as well as complex probate, will, trust and estate litigation disputes, litigation, estate and trust administration, estate planning, and taxation.

At the Firm, the attorneys in the Wills, Trusts, Estates & Taxation Department have the expertise and legal skills to handle cases ranging from areas including taxation issues, estate planning, probate and trust litigation, estate administration, trust administration, conservatorships and guardianships, and real property disputes.  Probate litigation, for example, involves legal and equitable disputes with respect to the
validity of a will, trust or other estate planning document based on fraud, undue influence, and lack of testamentary capacity.  Additionally, probate litigation includes legal disputes defending or litigating against beneficiaries, trustees, personal representatives, and other parties in cases that involve breach of fiduciary duty, attacks on the validity of estate planning documents, the interpretation and/or construction of wills and trusts, creditor’s claims, asset disputes, and various other legal disputes that may arise in relation to one’s passing.

Although the Firm cannot undertake the legal representation with every potential client,
when possible, the respective attorneys may provide an explanation as to different paths for the potential client to consider in finding a resolution to the potential client’s particular legal issue raised with consideration of each of potential client’s budget, using common sense and practical economic approaches to routine and complex legal issues.  The Department will also try to provide the potential client with realistic alternatives and courses of action given the potential client’s own special unique set of circumstances.
